Terms of Service
Effective Date: March 5, 2025
This Service Agreement ("Agreement") is entered into between Canine Advanced Training Services, LLC ("C.A.T.S.") and the pet owner ("Owner") for the provision of pet care and training services. By signing this Agreement, Owner acknowledges and accepts the terms outlined below and assumes full responsibility for their pet(s) (“Pet(s)”).
- Owner Representations & Acknowledgments
- Owner certifies that all information provided about their Pet(s) is accurate and up to date.
- Owner represents that they are at least 18 years of age and have the legal authority to enter into this Agreement.
- Owner acknowledges the inherent risks of boarding, daycare, training, and grooming, including, but not limited to, minor injuries (scrapes, scratches, bites), illness, stress, and unpredictable animal behavior.
- Services Provided
C.A.T.S. agrees to provide the following services based on the Owner’s selected care package:- Boarding & Daycare: Safe and supervised accommodations for Pet(s) in designated areas of the facility.
- Feeding: Meals and fresh water provided according to Owner’s instructions.
- Exercise & Enrichment: Daily exercise, playtime, and socialization opportunities as deemed appropriate by C.A.T.S.
- Medical Care: Prompt attention to any medical needs or emergencies. Veterinary care will be sought at the Owner’s sole expense, whether or not prior consent is obtained if the Owner cannot be reached in an emergency.
- Training Services
- Owner understands that dog training requires consistent reinforcement beyond sessions at C.A.T.S. The success of training depends on the Owner’s continued effort to follow training instructions.
- C.A.T.S. does not guarantee that Pet(s) will perform trained behaviors in all circumstances, as behavior varies based on environment, distractions, and reinforcement.
- Owner accepts full responsibility for the behavior of their Pet(s) before, during, and after training services. C.A.T.S. is not liable for any damage or injury resulting from failure to follow training guidance or improper handling of the Pet(s).
- Pet Health & Vaccination Requirements
- Owner certifies that their Pet(s) are in good health and up-to-date on all required vaccinations, including but not limited to:
- Dogs: Rabies, Bordetella, DHLPP (Distemper, Hepatitis, Leptospirosis, Parvovirus, Parainfluenza)
- Owner agrees not to bring Pet(s) to C.A.T.S. if they exhibit any signs of illness, such as vomiting, diarrhea, coughing, or extreme lethargy, without first obtaining approval.
- Pets arriving with fleas, ticks, or other parasites will be treated at Owner’s expense.
- C.A.T.S. reserves the right to deny service to any pet that shows signs of illness, aggressive behavior, or fails to meet vaccination requirements.
- Owner certifies that their Pet(s) are in good health and up-to-date on all required vaccinations, including but not limited to:
- Fees, Payments & Cancellations
- All service fees are due in part at the start of service, in full at the end of services and are non-refundable.
- Additional charges apply for extra services, emergency veterinary care, or special accommodations requested by Owner.
- Late pickups from boarding or daycare may incur additional charges.
- Unpaid balances are subject to collections. Any outstanding payment not received within 90 days of the due date may be referred to a collections agency, and the Owner will be responsible for all associated fees and legal costs.
- Cancellation Policies:
- Standard Booking: 25% or other specified dollar amount deposit required. Fully refundable if canceled 2+ days before check-in. Non-refundable if canceled 1 day or less before check-in.
- Holiday Booking: 25% or other specified dollar amount deposit required. Fully refundable if canceled 5+ days before check-in. Non-refundable if canceled 2 days or less before check-in.
- Liability & Assumption of Risk
- Owner understands that Pet(s) participating in training, boarding, daycare, or other activities may be exposed to risks inherent in pet care, including but not limited to injury, illness, or stress-related conditions.
- Owner agrees to release, waive, and hold harmless C.A.T.S., its staff, and affiliates from any claims, damages, or liabilities related to injuries, illnesses, accidents, or losses that may occur while Pet(s) are under C.A.T.S. care, except in cases of gross negligence or intentional misconduct.
- Owner assumes full liability and expenses for any injuries inflicted by their Pet(s) on other animals or humans while in C.A.T.S.'s care.
- Emergency Contact & Veterinary Care
- Owner must provide accurate emergency contact information, including an alternative contact in case they cannot be reached.
- In the event of a medical emergency, C.A.T.S. will make reasonable efforts to contact the Owner. If unreachable, C.A.T.S. is authorized to seek veterinary care at the Owner’s expense.
- Photography, Video, & Marketing
- C.A.T.S. may take photographs and/or videos of Pet(s) while in its care and may use such media for marketing purposes without compensation or liability to the Owner.
- Owner waives any claims related to the use of their Pet(s)' likeness in promotional materials, including social media, websites, and advertising.
- Facility Policies & Right to Refuse Service
- C.A.T.S. reserves the right to modify its policies and procedures without prior notice.
- C.A.T.S. may refuse service or adjust the type of care provided if:
- A Pet exhibits dangerous or aggressive behavior.
- A Pet requires separation from a family group for safety reasons (additional charges may apply).
- Owner violates facility rules or provides inaccurate pet information.
- An outstanding balance remains unpaid.
- Arbitration & Governing Law
- Any disputes arising from this Agreement must be resolved through arbitration in accordance with the American Arbitration Association (AAA) rules.
- The prevailing party in any arbitration shall be awarded costs, including reasonable attorney’s fees.
- This Agreement is governed by the laws of the State of Texas.
- Digital Consent & Electronic Signatures
- By submitting this Agreement electronically, including but not limited to online form submission, digital signature, or email confirmation, the Owner agrees that this electronic submission constitutes a legally binding signature equivalent to a handwritten signature.
- The Owner acknowledges that electronic records related to this Agreement may be stored and retained by C.A.T.S. as proof of acceptance.
- The Owner waives any right to challenge the enforceability of this Agreement solely on the basis that it was submitted electronically.
- Acknowledgment & Agreement
By signing below or digital consent, the Owner acknowledges that they have read, understood, and agreed to all terms and conditions outlined in this Agreement. This document constitutes the entire agreement between the parties and supersedes any prior discussions or agreements, whether written or verbal.
